~So today a friend of mine got their vehicle "double" clamped by the same company in London, probably CDER Group. The Bailiff told them that within two hours they will tow the vehicle away. My friend sat in the car waiting because they cannot tow the vehicle with you sat inside it. I got on the phone to my friend who passed me the phone to the Bailiff. I told him this vehicle does not belong to that driver, and under the Taking Control of Goods Regulations 2013, Schedule 12 part 2, an enforcement agent is strictly forbidden from siezing or clamping any vehicle that does not legally belong to the debtor. I informed the Bailiff that if he tried to move that vehicle he would be breaking the law. He told me he won't move it, but he won't release the clamps until friend paid £1000. He wanted proof emailed to the office that the vehicle did not belong to him. I told him it would take me around 4 hours to get this over to the office because I was busy.. 2hours later, the bailiff removed both clamps and left, without me sending any proof in. I think there are a few reasons for this. Waiting over 4 hours for papework, is taking up their time that they could be clamping other cars.. I am sure they work on commission. Clamping a car which you have been told is not theirs goes against the regulations. He knew he could not tow it, and due to the increase in clamps being removed, it was cheaper for him to remove the clamps himself than stand the chance to lose a good fewBAILIFFS hundredAND poindsCAR inCLAMPING! clamps.
